3.Visiting our website

Stunt Cloud only collects, processes and stores your personal data when you visit the website if there is a corresponding legal basis.

As a rule, you can use our website without providing us with personal information directly. For some services, we will request personal information from you in order to be able to process the respective service quickly and in a user-friendly manner or to be able to offer the service at all.

Some data is already collected automatically and for technical reasons when you visit our website. This data is temporarily stored on the web server in a so-called log file. The following information is collected without your explicit intervention: - The IP address of the requesting computer

- Date and time of access

- Name and URL of the file accessed

- The website from which the file was accessed (referrer URL)

- The browser used and, if applicable, the operating system of your computer as well as the name of your access provider.

The above data is processed by us for the following purposes:

- Provision of the website

- To ensure a smooth connection to the website

- Ensuring a comfortable use of our website

- Evaluation of system security and stability

The above-mentioned data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. In normal operation, this period is seven days. If activities are detected that negatively affect our stated purposes, we reserve the right to store the data for a longer period.

The legal basis for this data processing is Art. 6 para. 1 p. 1 lit. f) DSGVO as well as § 9 TTDSG. Our legitimate interest follows from the purposes for data collection listed above. In no case do we use the collected data for the purpose of drawing conclusions about your person.

Your data will generally be processed in Germany or within the European Union. If, in exceptional cases, your data is processed in countries outside the European Union (i.e. in so-called third countries), this will be done if you have expressly consented to this or if it is necessary for our provision of services to you or if it is provided for by law (Art. 49 DSGVO). Furthermore, your data will only be processed in third countries if certain measures ensure that an adequate level of data protection exists (e.g. adequacy decision of the EU Commission or so-called suitable guarantees, Art. 44 et seq. DSGVO).

Retrieval of the data published in your profile is possible worldwide.

4 Individual services

4.1 Use of cookies and local storage

Cookie

Cookies are small files that are automatically created by your browser and stored on your end device (laptop, tablet, smartphone, etc.). According to current knowledge, cookies cannot contain viruses, Trojans or other malware. In cookies, information is stored that arises in each case in connection with the specific end device used. This does not mean that we gain direct knowledge of your identity.

Local storage

Similar to cookies, information is stored in local storage (web storage) on your end device. However, in comparison to cookies, larger amounts of data can be processed more efficiently, and there is no automatic transmission to the web server each time a page is called up.

Use on the website

Necessary cookies or local storage are required for the operation of a website and are indispensable for navigating on it and using its essential functions. This data is not permanently stored on your computer or device and is deleted when you close the browser (session cookies, session memory). The legal basis for these storage techniques is Art. 6 para. 1 lit. f) DSGVO (legitimate interest) as well as § 25 para. 2 2nd TTDSG.

Various external media enable, for example, the integration of videos or map services on our website or in a profile. These cookies and storage technologies are necessary so that the external media can be embedded and displayed in a convenient form. Without consent, you can use the basic functions of the website, but not these special functionalities. The stored data is saved for different lengths of time, sometimes several years, by the service providers in your browser. Further information on these services can be found in these data protection notices. The legal basis for these storage techniques is Art. 6 para. 1 lit. a) DSGVO (consent) as well as § 25 para. 1 TTDSG.

Data storage for statistical purposes allows us to record and count the number of visitors and traffic sources in order to measure and improve the performance of the website. They are also used to find out if problems or errors occur on certain pages, which pages are most popular and how visitors navigate the website. Such analytical memories are deleted after a defined retention period. The legal basis for these cookies is Art. 6 para. 1 lit. a) DSGVO (consent) and § 25 para. 1 TTDSG.

4.2 Registration as a Performer

The data processing of your registration as a Performer is essentially based on the legal basis of the fulfilment of the contract according to Art. 6 para. 1 lit. b) DSGVO. The basis is the contract of use, which comes into effect with the registration and payment of fees. For individual types of data, data processing is based on your separate consent to the processing of personal data of special categories in accordance with Art. 9 (2) a) DSGVO. You give this consent by providing the corresponding data.

In order to fulfil the contract, it is necessary to process some personal data. This includes your name, address, contact data, website access data and payment data. Without the provision of this data, we are not able to fulfil the user contract.

We process this data in order to present your profile appropriately on our website in accordance with the user agreement.

It is necessary to provide further data about your profile that will be published on the website. This includes, for example, photos and videos, details of skills and abilities, height and stature, ethnic origin, nationality and language skills. Some of these are special category personal data, the processing of which is based on your explicit publication in accordance with Art. 9(2)(e) of the GDPR. You can remove this data by editing your profile.

Recipients of your personal data are all users of this website, whereby particularly sensitive data is only provided to registered coordinators, casters and choreographers. We do not actively pass on your data to third parties.

Your registration and profile data will be stored for as long as is necessary to fulfil the user contract.

4.3 Registration as a coordinator

The data processing of your registration as a coordinator is based on the legal basis of the fulfilment of the contract according to Art. 6 Para. 1 lit. b) DSGVO. The basis is the contract of use, which comes into effect with the registration and payment of fees.

In order to fulfil the contract, it is necessary to process some personal data. This includes your name, address, contact data, website access data and payment data. Without the provision of this data, we are unable to fulfil the user contract.

We process this data in order to provide you with full access to Performer profiles in accordance with the User Agreement.

It is necessary to provide further data about your profile that will be published on the website. This includes, for example, photos and videos and details of previous projects.

Your registration and profile data will be stored for as long as is necessary to fulfil the user agreement.

Recipients of your personal data are all users of this website. We do not actively pass on your data to third parties.

4.4 Payment function

We use the service provider Digistore24, which processes the payment for us, to settle the contractual fee. This service provider is committed to data protection.

Within the framework of the payment process, the service provider carries out a credit check at its own discretion, if necessary.

A plugin offers the possibility of integrating various services from Digistore24 on your own website, e.g. the Social Proof Bubble, the affiliate advertising generator or other tools.

With each integration, non-personal data is reloaded from the Digistore24 server. During this reload, your web browser retrieves a web page from the Digistore24 server. Our server has no influence on the extent to which your web browser transmits data to the Digistore24 server. Our server itself does not transmit any data to the Digistore24 server in this context.

Digistore24 GmbH, as the responsible party, explains in its own data protection declaration which data Digistore24 stores and processes when this website is accessed. You can find Digistore24's data protection declaration here: https://www.digistore24.com/dataschutz.

4.5 Website tracking

Actual no tracking.

4.6 Video insertion with YouTube

Stunt Cloud has integrated YouTube components on this website. YouTube is an internet video portal that allows video publishers to post video clips free of charge and other users to view, rate and comment on them free of charge.

The operating company of YouTube is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Each time one of the individual pages of this website, which is operated by Stunt Cloud and on which a YouTube component (YouTube video) has been integrated, is called up, the internet browser is automatically caused by the respective YouTube component to download a representation of the corresponding YouTube component from YouTube. As part of this technical process, YouTube and Google receive information about which specific sub-page of our website you are visiting. This information may also be transmitted to a third country.

If you are logged in to YouTube at the same time, YouTube recognises which specific sub-page of our website you are visiting when you call up a sub-page that contains a YouTube video. This information is collected by YouTube and Google and assigned to your YouTube account.

YouTube and Google always receive information via the YouTube component that you have visited our website if you are logged into YouTube at the same time as calling up our website; this takes place regardless of whether you click on a YouTube video or not. If you do not want this information to be transmitted to YouTube and Google, you can prevent it from being transmitted by logging out of your YouTube account before accessing our website.

The privacy policy published by YouTube, which can be found at https://www.google.com/policies/privacy/, provides information on the collection, processing and use of personal data by YouTube and Google.

4.7 Video insertion with Vimeo

Plugins of the video portal Vimeo of Vimeo, LLC, 555 West 18th Street, New York, New York 10011, USA are integrated on our website. Each time you visit a page that offers one or more Vimeo video clips, a direct connection is established between your browser and a Vimeo server in the USA. Information about your visit and your IP address are stored there. By interacting with the Vimeo plugins (e.g. clicking the start button), this information is also transmitted to Vimeo and stored there.

If you have a Vimeo user account and do not want Vimeo to collect data about you via this website and link it to your membership data stored with Vimeo, you must log out of Vimeo before visiting this website.

The privacy policy for Vimeo with more detailed information on the collection and use of your data by Vimeo can be found at https://vimeo.com/privacy.

In addition, Vimeo calls up the Google Analytics tracker via an iFrame in which the video is called up. This is Vimeo's own tracking, over which we have no access or influence. You can prevent tracking by Google Analytics by using the deactivation tools that Google offers for some internet browsers. Users can also prevent the collection of data generated by Google Analytics and related to their use of the website (including your IP address) by Google, as well as the processing of this data by Google, by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout.

Various of our websites contain so-called embeddings of videos on Vimeo. If you would like information on the purpose and scope of data collection and use by Vimeo, as well as your rights and settings options for protection as a Vimeo customer, please refer to Vimeo's privacy policy (https://vimeo.com/privacy).

5 Duration of storage

The criterion for the duration of the storage of personal data is the respective legal retention period (especially for data for the fulfilment of contracts) or a fixed duration based on your consent or our overriding legitimate interest (especially for technical data). After expiry of the period, the corresponding data is routinely deleted if it is no longer required to achieve the necessary purposes.

In the event of a revocation, objection or a request for deletion, we will immediately check the necessity and permissibility of the deletion and, if necessary, implement it immediately.

6 Automated decision-making

Automated decision-making based on the collected personal data in the sense of Art. 22 DSGVO does not take place.
